Rule setDebt collectionTelemarketing
Federal

Presumed convenient 8 a.m.-9 p.m. local time at the consumer's location, any day.

Every day 8:00 a.m.–9:00 p.m.

15 U.S.C. § 1692c(a)(1) · 12 CFR § 1006.6(b)(1)(i) (Regulation F) · Reg F Official Interpretation, comment 6(b)(1)(i)-2 (consumer's location) · 12 CFR § 1006.14(b)(2)

  • Call-frequency presumption: a collector is presumed to comply with the harassment ban if it places no more than 7 calls to a person about a particular debt within 7 consecutive days, and no call within 7 days after a telephone conversation with that person about the debt; exceeding either is presumed a violation (12 CFR § 1006.14(b)(2)).
  • Conflicting location information: if the collector's information indicates the consumer may be in more than one place (e.g. an Eastern-zone area code and a Pacific-zone address), it complies only by calling at a time convenient in all of those locations (Reg F comment 6(b)(1)(i)-2).
  • A collector may not call at any time it knows or should know is inconvenient to the consumer (e.g. after the consumer says so), regardless of the 8 a.m.-9 p.m. default (15 U.S.C. § 1692c(a)(1); Reg F comment 6(b)(1)-1).

No federal Sunday or holiday ban, but a consumer's statement that a day or time is inconvenient makes calls then unlawful. The 8-9 window is a default presumption that the consumer's prior consent (given directly to the collector) or a court can override.

8 a.m.-9 p.m. local time at the called party's location, any day.

Every day 8:00 a.m.–9:00 p.m.

47 CFR § 64.1200(c)(1) (TCPA rules) · 16 CFR § 310.4(c) (Telemarketing Sales Rule)

  • No telephone solicitation to a number on the National Do Not Call Registry absent an established business relationship or the consumer's signed written permission (47 CFR § 64.1200(c)(2); 16 CFR § 310.4(b)(1)(iii)(B)).
  • Autodialed or artificial/prerecorded-voice telemarketing calls to wireless numbers, and prerecorded telemarketing calls to residential lines, require the called party's prior express written consent (47 CFR § 64.1200(a)(2)-(3)).
  • Sellers must honor company-specific do-not-call requests (47 CFR § 64.1200(d); 16 CFR § 310.4(b)(1)(iii)(A)).

TSR § 310.4(c) allows calls outside 8-9 with the person's prior consent; the TCPA time rule in § 64.1200(c)(1) has no consent exception for telephone solicitations as defined.

New York

No fixed statewide hours; state law bars contacting a debtor at unusual hours, read in line with the federal 8 a.m.–9 p.m. window.

Every day 8:00 a.m.–9:00 p.m.

N.Y. Gen. Bus. Law § 601(6) · 6 RCNY § 5-77 (NYC DCWP), Notice of Adoption Feb. 2026, eff. Sept. 1, 2026

  • Statewide: no communication with such frequency, at such unusual hours, or in such a manner as to abuse or harass the debtor (GBL § 601(6)).
  • New York City only: DCWP rules cap contact at 3 communications or attempts per account in 7 consecutive days across all media, and none after the consumer responds within that period (6 RCNY § 5-77(b)(1)(iii), eff. Sept. 1, 2026).
  • New York City only: DCWP rules apply to original creditors once they begin collection procedures (DCWP Notice of Adoption, Feb. 2026).

Statewide days reflect GBL § 601(6)'s unquantified 'unusual hours' standard, modeled as 8 a.m.–9 p.m. Within New York City (the five boroughs only), 6 RCNY § 5-77(b)(1)(i) separately limits communications or attempts to after 8 a.m. and before 9 p.m. Eastern Time unless the consumer gave prior written consent or a court permits it; the amended rule takes effect Sept. 1, 2026. It is not applied statewide here.

8 a.m.–9 p.m. at the customer's location, any day, unless the customer expressly consents to another time.

Every day 8:00 a.m.–9:00 p.m.

N.Y. Gen. Bus. Law § 399-z(2) · N.Y. Gen. Bus. Law § 399-z(5-a)

  • No unsolicited telemarketing sales calls to anyone in a county, city, town, or village under a declared state of emergency or disaster emergency (GBL § 399-z(5-a)).

Emergency-declaration ban (GBL § 399-z(5-a)): no unsolicited telemarketing sales calls into an area under a governor-declared state of emergency or a local disaster emergency for as long as it lasts. The engine does not model this. A 2025 bill (S6853) would narrow it; check its status.

Is the 363 area code enough to know the person's local time?

No. Mobile numbers move with their owners and ported numbers keep their area code, so a 363 number may belong to someone in another time zone. If you know other locations for the person, the call should fit the window in all of them.
